Democrats Support Unconstitutional Bans Limiting Free Speech

Democratic Presidential Candidates have weighed in on laws being considered by States that would keep violent video games out of the hands of Kid's.

Hilliary Clinton cited her "Family Entertainment Protection Act" that would punish retailers with a fine of $1000 and 100 hours of community service.

John Edwards said that he "...supports the efforts of industry associations..." to curb games getting into the hands of Kid's.

Barack Obama believes that the government should be involved in restraining the industry and said, "...it's up to the government and gaming industry to provide comprehensive tools..."

The three leading Democratic candidates believe that government should regulate the industry and they hold gaming companies and retailers responsible for the sales of games. Wired Blog Network, December 26, 2007

Last year in California, USDC Judge Ronald Whyte, echoed a recent string of court rulings that struck down various state law bans of video games to minors as being unconstitutional for violating free speech, when he determined that California's law violated the 1st Amendment.

In 2006 a Federal Judge in Michigan ruled that a State law that barred retailers from selling or renting violent video games to minors was unconstitutional, Entertainment Software Assn. et. al. v. Jennifer M. Granholm, et. al. Case No. 05-73634, USDC, E.D. of Michigan.

In Louisiana a Federal Judge in 2006 likewise determined that the state law that barred the sale of video games to minors was unconstitutional. In Seattle, USDC Judge Robert Lasnik ruled in 2004 that the Washington State law was unconstitutional under the 1st Amendment.

Despite numerous Court rulings throughout the United States, Democrats continue to believe that Government knows what is best for you and your children. It was Hillary Clinton that once said, "It takes a Village to raise a Child."
