9th Circuit Court of Appeals Vacates Order


On August 31 the 9th U.S. Circuit Ct. of Appeals vacated the Order of Judge Florence Marie Copper, which had prevented the Navy from using Sonar off of the California coastline.

On August 7, I wrote here that Judge Copper ordered the Navy not to use Sonar off of Channel Island, as the political activist Judge, feared that Sonar may endanger 30 species of marine life and whales.

Under the caption of, Natural Resources Defense Council, Inc. , et. al. v. Donald Winter, Secretary of the Navy, et. al. Case No. 07-56157, D.C. Case No. CV-07-00335 the 9th U.S. Circuit Ct. said in their Order, "...We are currently engaged in war in two countries...the safety of the whales must be weighed and so must the safety of our warriors. And of our country..."

I wrote here a few weeks ago, "...Activist federal Judges, diminish the rule of law and have no legitimate grounds to make decisions based on their own views. Judges should use self-restraint and not intrude into areas of making policy that undermines our national security."
